Terms and Conditions of Use

This is an English translation of the Italian terms and conditions, provided for convenience. In case of any discrepancy, the Italian version prevails.

1. Description of the Service

QVADIS Growth is a SaaS content management and analytics platform for small and medium-sized businesses and creators. The service lets users manage the publishing of content on the main social networks (Facebook, Instagram, LinkedIn, TikTok), create newsletters, analyze performance and generate marketing materials with the help of artificial intelligence.

2. Acceptance of the Terms

By registering and using the platform, the user fully accepts these terms and conditions. If the user does not agree, they must stop using the service immediately.

3. Account and Access

• The user is responsible for the security of their login credentials
• Each account is personal and may not be transferred
• The user undertakes to provide accurate information when registering
• The user is responsible for all activities carried out through their account

4. Social Network Integrations

The platform integrates with Facebook, Instagram, LinkedIn and TikTok through their official APIs.

• Connecting each social account requires the user's explicit consent via OAuth
• Content is published only at the user's request
• The user can disconnect any social account at any time
• We do not automate interactions (likes, follows, comments) on social platforms
• The user undertakes to comply with the terms of service of each connected social platform

5. User Content

The user retains full ownership of the content created and published through the platform. QVADIS Growth claims no intellectual property rights over users' content. The user is solely responsible for the content published and warrants that they hold the rights needed to publish it.

6. Use of AI

The platform uses artificial intelligence models to assist in creating content. AI-generated content consists of suggestions that the user can edit, approve or reject before publication. The user is responsible for the final review and approval of all content.

7. Credits and Payments

• Each plan includes a monthly allowance of credits; features that use external providers (text, image and video generation, web search, sending emails/messages) consume credits according to the price list in force
• Credits are reset and renewed at the start of each billing cycle; unused credits do not carry over to the following period, unless otherwise stated
• Credits and fees cannot be refunded except as required by law
• Prices may change with notice and apply from the next renewal

7a. Renewal, cancellation and failed payment

• Automatic renewal: the subscription renews automatically when it expires (monthly or yearly) and the fee in force is charged, unless canceled.
• Cancellation: possible at any time from the management area; it takes effect at the end of the period already paid, with no penalties. There is no pro-rata refund for the current period.
• Failed payment: if a charge fails, the service may be suspended; data is not deleted and can be recovered once payment is settled.
• AI-generated content: it is intended as support and must be checked by the user before publication; responsibility for published content remains with the user.

8. Limitation of Liability

QVADIS Growth is provided "as is". We do not guarantee uninterrupted availability of the service. We are not liable for any losses resulting from changes to the APIs of connected social networks, temporary service interruptions or actions taken by social platforms on users' accounts.

9. Prohibited Use

The platform may not be used for:

• Spam or unauthorized mass mailing
• Illegal or defamatory content, or content that infringes the rights of others
• Attempts to circumvent the limits of social network APIs
• Scraping or automated data collection
• Any activity that breaches the terms of connected social networks

10. Termination

We reserve the right to suspend or close accounts that breach these terms. The user can delete their account at any time from the settings or by contacting serges@qvadis.it.

11. Changes to the Terms

We reserve the right to change these terms. Changes will be published on this page. Continued use of the platform after the changes have been published constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by Italian law. Any dispute shall fall under the jurisdiction of the court competent for the provider's registered office.
